What Does Spain's €1,000 Cash Rule Actually Say?

Article 7 of Ley 7/2012, tightened from 11 July 2021, bars cash for any transaction of €1,000 or more where one party acts as a business or professional. For a private payer whose tax home is outside Spain the limit is €10,000. Payments for the same service are added together, and payer and recipient are both liable.

The Rule in Four Points

1. The limit is €1,000 where a business or professional is a party, and €10,000 for a private individual who proves a tax home outside Spain. Before 11 July 2021 they were €2,500 and €15,000.
2. Instalments and split payments for the same service count as one transaction.
3. Payer and recipient are jointly liable for a fine of 25% of the cash paid; the first of the two to report the payment to the tax agency within three months is exempt.
4. Cash means the bearer means of payment defined in Spain's anti-money-laundering law, notes, coins, bearer cheques and anonymous prepaid cards among them. A bank transfer is not on that list, and nor is crypto.

The rule is about payments in Spanish commerce generally. It is why a jeweller, a car-hire desk or a charter company will ask for a transfer or a card above the line, and why sellers tend to refuse large notes: both sides share the fine, so neither wants to be holding the cash. Transfers From Outside the Euro Area

A transfer from a bank outside the euro area travels as an international payment and can take a working day or more, so for a deposit on a booking this week, crypto is usually the quicker route. Send euros rather than your own currency, and choose to pay the fees yourself, so the full amount arrives and nobody has to chase a shortfall of €15 on the night. A euro account, if you have one, avoids both problems.

Paying in Crypto
