The ones that do not tend to fail on the same four points: a rental contract nobody read, music outside after midnight, a gate with no list, and a guest count that doubled during the evening. None of those is about money, and all of them can be settled before the first guest arrives. Guests invited by name keep a party private; a post on social media with a door charge does not. That is a process built for venues, not for a rented house on a Saturday. If the guest list is turning into a ticket list, move the event somewhere licensed.

Marbella's Noise Rule: Why Midnight Is the Line
Marbella's coexistence ordinance prohibits disturbing the neighbours' rest with music, television, singing or shouting, especially between 00:00 and 08:00, unless the town hall has authorised it. Residents must keep sound equipment from carrying outside their homes. A breach is a minor offence carrying a fine of up to €750.
What the Ordinance Says, and What It Means at 00:30
The text is article 63 of Marbella's ordinance on coexistence, approved on 30 November 2018 and published in the provincial bulletin on 18 June 2019. It names sound equipment, singing and shouting, and singles out the hours from midnight to eight; article 64 sets the fine at up to €750. In practice the first sign is a patrol at the gate after a neighbour's call, with a simple request to turn it down. Doing so at once usually ends the matter. Arguing is how a warning becomes a report.
Designing the Night Around Midnight
Plan two halves. Outside: drinks, dinner, the pool and conversation. Inside from 23:30: the speakers, the dancing and the louder part, with doors and windows on the neighbours' side closed. Daylight helps the plan. Sunset in Marbella is at about 21:40 in late June, 21:10 in mid-August and 20:30 in mid-September, so a 20:30 start gives three hours of terrace before the move indoors. Book any DJ for an indoor set rather than a pool-deck one, and tell them the rule before they quote.
The Rental Contract, the Statutes and the Neighbours
Two private rulebooks sit on top of the law: the rental contract and the community's statutes. Andalucía's tourist-rental decree lets the operator require guests who break the rules of coexistence to leave within 24 hours, and in a community of owners a persistent nuisance can end in a court order.
Read the Event Clause Before You Pay
Under Decreto 28/2016, a registered tourist rental gives each guest a contract-style document stating, among other things, how many people will occupy the house, and the operator can require guests who breach the rules of coexistence to leave within 24 hours. Many villa contracts add a ban on events, a cap on visitors and a damage deposit. Ask in writing before booking: how many guests, until what time, with what music. Community Statutes and the Owners Who Enforce Them
Many urbanisations are communities of owners under the Ley de Propiedad Horizontal. Its article 7.2 bars activities that the statutes prohibit or that are a nuisance; the president can demand they stop, and a court can deprive an owner of use for up to three years or end an occupant's rights altogether. Since 3 April 2025, a three-fifths majority can also limit or ban tourist rentals in a community, so owners' meetings watch rented villas closely. Tourist homes made up 6.97% of Marbella's housing in May 2026, by INE's count.
The Note to the Neighbours, 48 Hours Ahead
The cheapest insurance is a note through the neighbours' gates two days ahead: the date, the time the music moves inside, the time the cars leave, and a mobile number to call before calling anyone else. A neighbour with your number usually calls you first. Send the same details to the urbanisation's administrator or guard, who takes the complaints at night, and make sure whoever holds that phone is sober and awake until the last car leaves. Arrivals matter as much as music: guests waiting in the lane at a closed barrier, engines running, are louder than the party.
Staff, Catering and Security for a Villa Party
Staff to the numbers: in our experience, one server for every 12 to 15 guests, a barman once you pass 20, and a caterer for any seated meal. For security, a host with a list at the gate is enough for most private parties; anything that looks like policing must come from a licensed private security company.
Staffing Ratios That Hold Up
Up to about twelve guests, a private chef who cooks, serves and leaves before the late part of the evening beats catering on cost and calm. From 12 to 20, add a server and a barman; from 20 to 40, three or four servers and one or two at the bar; beyond 40, a full catering team. Under-staffing is the failure guests notice first: an empty bar at 23:00 sends people wandering through the house. Tell staff the finish time and the inside-after-midnight plan, and pay them to the last car, not the last course.
A Host at the Gate, or Licensed Security?
Spain's private security law, Ley 5/2014, reserves surveillance and protection to authorised security companies and their licensed staff (article 5.2), while receiving, checking and directing visitors may be done by porters, concierges and similar auxiliary staff (article 6.2). For a villa, that means a host with a printed list, a phone and a torch at the gate is lawful and usually enough. Searching bags, refusing entry by force or removing a guest is security work: book a licensed firm, or do not do it.
Guest Lists, Cars and the Timeline of the Night
Give the urbanisation's guard a list of names and expected cars a day ahead, tell the owner the real numbers, and set the evening's clock around midnight: arrivals from 20:30, food by 22:00, music inside by 23:30, and the first cars booked for 01:30 rather than hailed.
The List the Guard Needs
A guard with no list phones the house for every car. Send the guard, or the villa's manager, the names and rough arrival times a day ahead, with the number plates you know, and nominate one person to answer the gate phone. Keep the list closed: a party of 25 becomes 50 when the address circulates in a group chat, and the extra 25 are the ones who arrive loudly at 01:00. When a name is missing, the host decides at the barrier, never the guard.
A Timeline That Works in August
- 20:30: guests arrive, about forty minutes before an August sunset (21:12 on the 15th).
- 22:00: food served, seated or standing.
- 23:30: music and dancing move inside; doors closed on the neighbours' side.
- 00:00: the ordinance's protected hours begin; the terrace stays conversational.
- 01:30: first cars, booked in advance.
- 03:00: last cars; staff paid to this point.

When the Villa Is the Wrong Place for the Party
Move the party if the guest list passes about forty, the contract bans events or the neighbours are a hedge away. A beach club, a yacht or a restaurant's private room comes with its own licence, staff and closing time, and the villa keeps the quieter end of the night.
