Key Takeaways:
  • Every villa let to tourists in Andalusia needs a Registro de Turismo de Andalucía code, shown in every advert: VUT/MA or the older VFT/MA prefix
  • Spain's national rental registry (RD 1312/2024) had its registration procedure annulled by the Supreme Court in May 2026, after the Ministry had revoked 2,993 Marbella applications
  • Four contract clauses matter most: the security deposit, the cancellation scale, the overnight-guest cap and the events ban
  • Summer 2027 weekly rates on Le Collectionist run from about €15,000 (five bedrooms, Guadalmina) to €89,000 (eight bedrooms, Sierra Blanca)
  • A companion is a visitor under most contracts: leave her name at the gate, drop a pin and tell us if staff live on site

The villa that looks best online is often the one that goes wrong in August: a code that does not exist, a contract that bans guests after midnight, a gatehouse that has never heard of you. As an escort agency in Marbella we send companions to these houses every week, so we see what goes wrong from the gate inwards. Pick the area first, then check three things before paying anything: the Andalusian licence code, the contract clauses on deposits, guests and events, and the extras the headline price leaves out.

If you are still deciding whether you want a villa at all, our hotels vs villas comparison settles that first. For the companion side of a stay, the pillar guide explains how booking a Marbella escort works.

Does a Marbella Holiday Villa Need a Licence Number?

Yes. Any villa let to tourists in Andalusia must be entered in the Registro de Turismo de Andalucía, and its code must appear in every advert, on Airbnb and Booking included. The code reads VUT/MA followed by a number, or VFT/MA on older listings. No code means no legal letting, and no protection for you.

Reading the Code: VUT/MA, VFT/MA and the Long ES Number

A VUT, or vivienda de uso turístico, is a home licensed for tourist lets in Andalusia and entered in the regional tourism register; Decree 31/2024 introduced the name, and plenty of listings still carry the older VFT prefix for the same register. Some also show a long national number beginning ESFCTU, issued under the 2025 national registry. The same decree caps a whole-house licence at 15 guests, requires 14 m² per guest, a 24-hour phone line and both cooling and heating. Ask the agent to put the code in the contract and check it against the address. A six-bedroom house licensed for eight is a house where the extra beds are your problem.

The National Registry the Supreme Court Cut Back

From 1 July 2025, Real Decreto 1312/2024 required every short-term rental advertised online to carry a Property Registry number. By January 2026 the Ministry of Housing had revoked 84,250 of 412,253 applications, 21%, and Marbella had 2,993 refusals, more than any other municipality in Málaga province, Málaga city included. Then a Supreme Court ruling of 19 May 2026, followed by two more on 21 May and 1 June, annulled the registration procedure. The data-sharing channel for platforms survived. In practice, the Andalusian code is now the number to check.

Community Approval Since April 2025

Since 3 April 2025, Spain's property-owners law has required a new tourist let inside a building or estate run as a community of owners to win the community's express approval, by a three-fifths majority. Licences granted earlier carry on. Many villas in Sierra Blanca, the Golf Valley and the Golden Mile sit inside such communities, with their own statutes on short lets, noise and guest parking. A legitimate agent will know whether the house has that approval; one who has never heard of the rule is telling you something about the rest of the paperwork.

Six Villa Areas Compared: Price, Privacy and Minutes to Puerto Banús

Nueva Andalucía for nightlife and golf, five to ten minutes from Puerto Banús. Sierra Blanca for privacy above the Golden Mile. La Zagaleta for maximum security. Benahavís for space and quiet. Los Monteros and East Marbella for wide beaches. Guadalmina for an older, low-density villa district by the sea, west of San Pedro.

The Area Comparison We Give Clients

Price bands are July–August 2027 weekly rates on Le Collectionist's Marbella calendars for villas it lists in each area; minutes are off-peak driving times.

Near the Port or Above It

Nueva Andalucía, one of Marbella's five districts, grew from José Banús's 1964 development and wraps Puerto Banús and the Golf Valley; the neighbours are residents rather than holidaymakers, and they set the noise rules in practice. Sierra Blanca sits directly below La Concha, gated, with no shops or bars inside; our Sierra Blanca guide covers access. La Zagaleta, roughly 900 hectares behind a single guarded gate, had no villa on the platform we priced, so expect a private quote; every visitor is cleared at the gate against a resident's authorisation.

Beach Districts: Los Monteros, Las Chapas and Guadalmina

East of town, the Los Monteros villas we priced sit about ten minutes' walk from the sand, and Hacienda Las Chapas and the Artola dunes near Cabopino are quieter still; our East Marbella guide covers the evenings. The trade is fifteen to twenty-five minutes to Puerto Banús. Guadalmina, at the western edge of San Pedro, grew around Marbella's first golf course, built in 1959, with the Roman baths of Las Bóvedas by the river mouth. Low density, old money, and the lowest summer prices of the six areas here.

Reading a Marbella Villa Rental Contract: Deposits, Parties, Visitors

Four clauses decide whether a villa week goes smoothly: the security deposit and how deductions are proved, the cancellation scale, the cap on overnight guests, and the ban on events and amplified music. Read all four before paying, and get any exception, such as a dinner for twelve, in writing.

The Security Deposit and the Damage Clause

Le Collectionist's terms are a good benchmark. A booking payment within three business days of signing, the balance two months before arrival, and cancellation at 50% of the rent up to 60 days out and 100% after that. The security deposit is set in the contract, used only for repairs or replacement "upon presentation of evidence provided by the owner", and nothing is withheld "without a thorough inspection". Ask for the figure before you sign. On day one, walk the house with the caretaker and photograph anything chipped, stained or already broken.

Party, Noise and Occupancy Clauses

Expect a cap on overnight guests at the licensed number, a ban on events, and quiet hours. Spanish noise law treats 23:00 to 07:00 as night under Real Decreto 1513/2005, and Andalusia's 2024 decree allows the police to help remove guests who break the usual rules of coexistence. A dinner for six is not an event; forty people and a DJ is. If the party is the point of the trip, our villa party planning guide covers event-friendly houses and staffing.

Pool Heating, Staff and the Costs Outside the Headline Price

The weekly price is the house. Ask separately about pool heating, which is usually off outside high summer; how often housekeeping comes; whether a caretaker lives on site; and what a chef, a driver or extra cleaning cost. On Le Collectionist's Marbella list, included housekeeping ranges from once a week to daily.

Pool Heating: Ask for the Date and the Price

Of the 23 Marbella villas on Le Collectionist's list with a published pool specification, 14 have only unheated pools, and 20 listings offer heating on request in certain periods, possibly at extra cost. In July and August it barely matters; in May or October it decides whether anyone swims. Ask whether heating is included, from which date, and at what daily cost, and get the answer in the contract rather than a friendly message.

Housekeeping, Caretakers and Chefs

Seventeen of the 41 Marbella listings we reviewed include housekeeping seven days a week; the rest range from once to six times. Several houses have a caretaker living on site in separate quarters, and the top tier adds a property manager, a butler or a security guard. A private chef runs about €80–€200 a head. Staff on this coast are professionally incurious, but they see every arrival, so tell them how many guests to expect and tell us when they will be working.

Red Flags in Marbella Villa Listings

No VUT/MA or VFT/MA code, a request to pay by bank transfer outside the platform, a price far below similar villas in the same area, photos that also appear on other listings, and no written contract. Any one of these is reason to slow down; two together usually mean the villa is not what it seems. And one trap that looks legitimate.

Payment Off-Platform and Other Warning Signs

  • Off-platform payment: a discount for paying a personal account by transfer removes every protection the platform offers.
  • The missing or mismatched code: no code, or one registered to a different address.
  • The impossible price: far below comparable houses in the same area and week, with photos from the top of the market.
  • No contract, no deposit figure: legitimate agents send both before taking money.
  • No live video: an owner who will not walk the house on a call has a reason.

Registered Is Not the Same as Available

In August 2024 the INE counted 7,516 tourist rentals actually marketed in Marbella, against 13,857 on the Andalusian register; a University of Málaga study put the share of registered homes really being let at 32%. A valid code proves the house was declared, not that the photos are current or that it is free in August. Ask for a dated video, the exact location and a named contact who will hand you the keys.

Booking a Companion at a Rental Villa: Visitor Clauses and Gates

A companion at a rental villa is a visitor, and most contracts allow visitors while capping overnight guests at the licensed number. In a gated urbanisation, leave her first name at the gatehouse or send us the code, drop a pin, and tell us if a caretaker or staff will be at the house.

What the Visitor Clause Means in Practice

An evening visitor sits outside both the guest cap and the registration rules, which cover people who stay. If a booking turns into several nights, the agent may need her added as a registered guest, which is routine. An overnight companion (10–12 hours, €3,000–€4,000 depending on the companion and the length) is the format villas suit best; a multi-day stay is booked at the travel rate, €5,000 a day or €6,000 for the 48-hour weekend. Villas in Benahavís and Estepona are outside Marbella, so hourly bookings carry a two-hour minimum and the client pays her taxi, and a dinner for two never counts as an event under any clause we have read.

Gates, Pins and Neighbours

The gate is the only friction, and it takes one message. Ask the agent how guests are announced and whether the code changes weekly. Then leave her first name with security earlier in the evening, or send us the code, and drop a pin, because villa numbers inside estates make no sense from the road. In La Zagaleta, the resident or the rental manager has to clear her name with the gate in advance. In Nueva Andalucía the neighbours are permanent residents, so keep terrace music down after 23:00. For duo bookings, a villa with separate living areas is the format that works.

How We Would Shortlist a Villa for a Client

Start from the trip, not the photos: who is coming, how many nights, and how much driving you will tolerate. Pick the area, then check the code, the contract clauses and the extras, and only then fall in love with the pool. A good shortlist rarely runs past three villas.

Five Checks Before You Pay the Booking Deposit

Every villa a client sends us goes through the same five questions, in this order.

  1. The VUT/MA or VFT/MA code, written into the contract and matching the address.
  2. The deposit figure, the damage-evidence clause and the cancellation scale.
  3. The overnight-guest cap and the events clause, read against your actual plans.
  4. Pool heating dates, housekeeping frequency and who lives on site.
  5. The gate procedure, and how guest registration is handled before arrival.

Matching the Area to the Trip

A weekend of dinners and clubs belongs in Nueva Andalucía, five minutes from the port. A privacy-first week belongs in Sierra Blanca or Benahavís, with a driver booked. Long beach days point east to Los Monteros or west to Guadalmina, and security above everything points to La Zagaleta, at La Zagaleta prices. Send us the area and the dates when the villa is confirmed, and we will plan arrivals around the gate rather than discovering it on the night.

Frequently Asked Questions

How do I check a Marbella holiday villa is legal?

Ask for its Registro de Turismo de Andalucía code, which must appear in every advert and starts VUT/MA or, on older listings, VFT/MA. Check it is written into the contract and matches the address. If the villa sits in a community of owners and was licensed after 3 April 2025, ask whether the community approved it.

Is the Spanish national holiday-rental registration number still required?

Not as it was. The Supreme Court annulled the registration procedure of Real Decreto 1312/2024 in rulings from May and June 2026, although the data-sharing system for platforms survived. Some listings still show the long ES number. In Andalusia, the regional VUT or VFT code remains the requirement that matters.

How much is the security deposit on a Marbella villa?

It varies by house and is set in the rental contract, so ask for the figure before you sign. Reputable agents hold it against documented damage only; Le Collectionist, for example, deducts only on evidence from the owner after a thorough inspection. Photograph the house on arrival so the inventory works in your favour.

Which area of Marbella is best for renting a villa?

It depends on the trip. Nueva Andalucía suits nightlife and golf, five to ten minutes from Puerto Banús. Sierra Blanca and Benahavís suit privacy. Los Monteros and Guadalmina suit beach days, and La Zagaleta suits those who want a guarded gate above everything else, at a considerable price.

Can I have guests over at a rented villa in Marbella?

Normally yes, within the contract. Most agreements allow visitors but cap overnight guests at the licensed number and ban events and amplified music late at night. In a gated estate, announce visitors at the gatehouse or share the code, and keep the terrace quiet after 23:00, when Spanish noise rules switch to night limits.

Staying at a Villa? Send Us the Gate

Once the villa is booked, send us the urbanisation, a map pin, the gate arrangement and whether staff live on site, together with your dates and the shape of the evening. We will confirm a companion and the price, and plan the arrival around the gate.
